1. Agreement to Terms

By accessing or using the Illuminate service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including parents, guardians, and students.

2. Service Description

Illuminate provides educational guidance services that combine artificial intelligence analysis and assessment tools to help students explore potential college majors and career paths. Our Service includes:

• AI-powered analysis of student strengths, interests, and academic records
• Access to the proprietary AI tool to ask questions
• Testing and assessment tools
• Document curation and resource portal

4. No Guarantees

Illuminate makes no guarantees, warranties, or representations regarding:

• Academic success or college admission
• Career outcomes or employment opportunities
• Financial return on educational investment
• Accuracy or completeness of AI-generated recommendations
• Suitability of recommended majors or career paths for any particular student

5. User Eligibility and Consent

The Service is intended for use by parents, legal guardians, and students preparing for college. By using the Service:

• If you are a parent or guardian, you represent that you have authority to consent on behalf of the student
• If you are a student under 18, you represent that you have obtained parental or guardian consent
• You consent to the collection and processing of student data as described in our Privacy Policy
• You consent to the use of AI systems to analyze provided information

6. Payment Terms

Enrollment in the Illuminate Program requires a one-time payment of $125. All payments are:

• Processed securely through Stripe payment processing
• Non-refundable after services have been initiated (assessments begun or documents uploaded)

7. User Data and Privacy

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. California Consumer Rights

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA):

• Right to know what personal information is collected, used, shared, or sold
• Right to delete personal information
• Right to opt-out of the sale of personal information (Note: we do not sell personal information)

9. Intellectual Property

All content, software, assessments, AI models, reports, and materials provided through the Service are the intellectual property of Illuminate and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Reproduce, distribute, or create derivative works from our proprietary assessments or AI models
• Use our Service for commercial purposes without written permission
• Reverse engineer or attempt to extract source code from our AI systems

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, ILLUMINATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any reliance on AI-generated recommendations or analysis
• Educational or career decisions made based on our Service
• Errors, inaccuracies, or omissions in content or recommendations

Our total liability shall not exceed the amount you paid for the Service ($125).

11. Indemnification

You agree to indemnify and hold harmless Illuminate, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California.
